Effective Date: March 1st, 2026
This Web Hosting Terms of Service (“Agreement”) governs web hosting services provided by Invisible Gold, LLC. (“Invisible Gold”, “we”, “us”, or “Host”) to the customer (“Client”, “you”, or “your”).
By using hosting services, Client agrees to this Agreement.
Invisible Gold provides internet web hosting services consisting of server space, network connectivity, and related technical services (“Hosting Services”) for Client-supplied website files and applications.
Hosting Services are limited to storage and delivery of Client website data.
This Agreement applies only to websites and files supplied by Client.
This Agreement does NOT apply to, and does not grant any
rights to, the Invisible Gold software platform, content management
system, or any hosted application service operated by Invisible
Gold.
Use of the Invisible Gold platform is governed by
a separate Software Service Agreement.
Client retains full ownership of:
• website files
• images
• text content
•
databases uploaded by Client
• email content
Invisible Gold does not claim ownership of Client materials.
Client represents they have legal rights to all content they upload.
Hosting services are provided on a month-to-month basis unless otherwise agreed in writing.
Either party may terminate hosting at any time.
Invisible Gold may suspend or terminate service for:
• non-payment
• abuse of services
• security
risk
• illegal or prohibited content
• violation of
this Agreement
Termination of hosting does not transfer ownership of servers or infrastructure to Client.
Client is solely responsible for maintaining independent copies and backups of all website files, databases, and email.
Invisible Gold may perform courtesy backups for operational purposes, but:
• backups are not guaranteed
• backups may not be
complete
• backups may not be restorable
Invisible Gold is not a data backup or archival service.
Client agrees Invisible Gold shall not be liable for data loss under any circumstances.
After termination of hosting:
• account data may be deleted at any time after 10 days
•
Invisible Gold is not obligated to store or preserve website data
•
restoration may not be possible
Clients are strongly encouraged to download their data before cancellation.
Invisible Gold may, at its discretion, assist with data retrieval, but this is not guaranteed.
Hosting Services are provided on a best-effort basis.
Invisible Gold does not guarantee uninterrupted availability.
Service interruptions may occur due to:
• maintenance
• hardware failure
• software
updates
• internet outages
• security incidents
•
events beyond our control
Downtime does not constitute breach of contract.
Client may not use Hosting Services for:
• sending spam or unsolicited email
• hosting malware
•
illegal content
• copyright infringement
• harassment
•
phishing
• hacking attempts
• bulk mailing operations
•
botnets or command servers
Invisible Gold may immediately suspend service without notice if such activity is detected.
No refunds will be issued for termination due to violations.
Client is responsible for maintaining the security of:
• passwords
• CMS installations (WordPress, plugins,
themes, etc.)
• scripts and third-party software
If a site becomes compromised, Invisible Gold may suspend access to protect the network.
Invisible Gold is not responsible for:
• hacked websites
• injected malware
•
blacklisting
• security breaches
Cleanup or recovery may require paid service.
Client is responsible for compliance with all laws relating to:
• email communications
• data privacy
• payment
processing
• sales tax
• credit card handling
Invisible Gold does not provide PCI compliance and is not responsible for payment security.
Client is responsible for maintaining domain name registration and renewals.
Invisible Gold may assist with domain configuration but is not responsible for:
• registrar actions
• expiration
• transfer
failures
• DNS downtime
Loss of a domain name does not constitute failure of hosting services.
Services may be suspended for invoices more than 15 days overdue.
Accounts more than 30 days overdue may be terminated and data deleted.
Reasonable support may be provided during normal business hours.
Support includes:
• server availability issues
•
network connectivity
Support does not include:
• website development
•
design
• plugin troubleshooting
• personal computer
support
Support is provided only to the account holder.
Hosting services are provided “AS IS” and “AS AVAILABLE”.
Invisible Gold shall not be liable for:
• lost profits
• business interruption
• lost
data
• email loss
• downtime
Maximum liability shall not exceed fees paid in the previous 3 months.
Client agrees to defend and indemnify Invisible Gold against claims arising from:
• Client content
• Client business activities
•
legal violations
• intellectual property claims
This Agreement is governed by the laws of the State of Connecticut.
All disputes shall be resolved by binding arbitration in Connecticut, and both parties waive the right to a jury trial.
Invisible Gold may modify this Agreement at any time.
Changes
become effective 30 days after notice via website posting or email.
Continued use of services constitutes acceptance.
